Terms of Service

1. About These Terms

These Terms of Service (“Terms”) govern your access to and use of TPT Stay (“the Service”), operated by TPT Solutions Ltd (“we”, “us”, “our”), a company incorporated in New Zealand. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms apply to all users of the platform, including hosts, guests, and property managers.

2. The Service

TPT Stay is an accommodation booking platform that connects hosts offering short-term rental properties with guests seeking accommodation. We provide the platform technology; we are not a party to any accommodation agreement between a host and guest. Hosts are solely responsible for their listings and the accommodation they provide. We may update, modify or discontinue features at any time. We will give reasonable notice of material changes where practical.

3. Accounts and Access

• You must be at least 18 years old to create an account.
• You are responsible for keeping your login credentials secure. You are liable for all activity under your account.
• You must provide accurate, current information when registering and keep it up to date.
• We may suspend or terminate accounts that violate these Terms, at our discretion.

4. Host Obligations

• Hosts must ensure all listing information is accurate, including descriptions, photos, pricing, and availability.
• Hosts are solely responsible for complying with all applicable laws, regulations, and local authority requirements for short-term rentals.
• Hosts must honour confirmed bookings unless exceptional circumstances apply.
• Hosts must not discriminate against guests on grounds prohibited by applicable law.

5. Guest Obligations

• Guests must treat properties with care and respect house rules set by the host.
• Guests are liable for any damage caused to a property during their stay beyond normal wear and tear.
• Guests must not use properties for any unlawful purpose or events not permitted by the host.

6. Bookings and Payments

• A booking is confirmed when the guest receives confirmation and payment is processed via Stripe.
• Service fees are charged to guests at checkout and are non-refundable unless otherwise stated.
• Host payouts are processed after guest check-in, subject to our payout schedule.
• Cancellation refunds are subject to the cancellation policy selected by the host for each listing.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Create false listings, fake reviews, or misrepresent any information on the platform.
• Attempt to circumvent the platform by arranging payments outside of the Service.
• Scrape, copy or redistribute any part of the Service without our written permission.
• Upload or transmit malicious code, viruses, or harmful content.

8. Your Data

You retain ownership of all content you submit to the Service, including listing descriptions and photos. By listing on TPT Stay, you grant us a licence to display your content on the platform. See our Privacy Policy for full details on how we handle personal information.

9. Intellectual Property

The Service, including all software, designs, text, and trademarks, is owned by TPT Solutions Ltd and protected by New Zealand and international intellectual property laws. These Terms do not transfer any intellectual property rights to you.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind. We do not verify the accuracy of host listings or vet guests or hosts beyond our stated verification processes. You use the Service at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, TPT Solutions Ltd shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service, any accommodation booked through the Service, or the conduct of hosts or guests. Our total liability to you in any 12-month period shall not exceed the total fees you paid to us in that period.

Nothing in these Terms limits liability for fraud, death or personal injury caused by our negligence, or any liability that cannot be excluded by law.

12. Termination

Either party may terminate the agreement at any time. You may close your account from your account settings. We may suspend or terminate your access immediately if you breach these Terms. Active bookings will be honoured or cancelled in accordance with our cancellation policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts, unless otherwise required by mandatory consumer protection laws in your jurisdiction.
